On Monday June 27, Freestar Media, LLC informed the Towne of Weare, New Hampshire that it wants to begin the permit process to build a hotel on the land owned by Justice David H. Souter. Justice Souter’s vote in the “Kelo vs. City of New London” decision allows city governments to take land from one private owner and give it to another if the government will generate greater tax revenue or other economic benefits when the land is developed by the new owner.

This initiative asks the Town of Weare to use eminent domain to seize the land of Supreme Court Justice David H. Souter for the purpose of economic development through the construction of an Inn. It must be filed by the end of January and will be voted on in March 2006.

Campaign to seize US judge’s home

Activists angered by a US Supreme Court ruling that homes can be demolished for public developments are trying to seize the home of one of the judges involved.

About 60 people rallied in the small New Hampshire town of Weare on Sunday, where Justice David Souter has a house.

The protesters say they have enough signatures from Weare residents to put their proposal to a town vote in March.

They want a compulsory purchase order on the 200-year-old farmhouse, and say they will build a hotel in its place.

Campaign organiser Logan Clements, from Los Angeles, told supporters in Weare the Supreme Court had “shot a hole in the [US] Constitution”.
